Terms and Conditions

Please read these Terms and Conditions carefully before using the seeID platform. By creating an account or accessing any part of the service, you agree to be bound by these Terms. If you do not agree, you must not use seeID.
1. Acceptance of Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "Tenant", or "you") and seeID (Pty) Ltd ("seeID", "we", "us", or "our"), a private company incorporated under the laws of the Republic of South Africa (registration number available on request).
By registering for an account, accessing the seeID platform at https://seeid.co.za or any subdomain thereof, or by otherwise using the services we provide, you confirm that:
- You have read, understood, and agree to be bound by these Terms and our Privacy Policy.
- You are at least 18 years of age and, where acting on behalf of a legal entity, have the authority to bind that entity to these Terms.
- Your use of the platform complies with all applicable South African laws, including the Protection of Personal Information Act 4 of 2013 (POPIA), the Electronic Communications and Transactions Act 25 of 2002 (ECT Act), the Financial Intelligence Centre Act 38 of 2001 (FICA), and the Consumer Protection Act 68 of 2008 (CPA).
These Terms apply to all visitors, users, tenants, and others who access or use the seeID service. Your continued use of the platform after any amendments to these Terms constitutes acceptance of the updated Terms.
2. Description of Service
seeID is a South African identity verification and Know Your Customer (KYC) platform designed for institutions ("Tenants") that need to verify the identities of individuals in a secure, auditable, and POPIA-compliant manner.
The platform provides, depending on your subscription plan, some or all of the following services:
- Identity verification — single and batch South African ID number lookups against authoritative government data sources.
- Biometric and liveness checks — facial recognition and proof-of-life video capture to confirm that a document holder is a real, live person.
- Document authenticity — automated checks on South African identity documents for tampering, fraud indicators, and data integrity.
- Compliance screening — PEP (politically exposed person) and sanctions list checks, adverse media monitoring, and FICA risk scoring.
- Financial and business checks — account verification services (AVS), credit bureau queries, CIPC company lookups, and deeds registry searches.
- Credential verification — qualification authentication, professional registration status, and SAPS criminal record checks (Brave and Kings plans only).
- Address and contact verification — RICA subscriber lookups and residential address corroboration.
seeID acts as an intermediary that facilitates queries to authoritative third-party data providers. We do not warrant the accuracy or completeness of results returned by those providers. All verification results should be treated as supporting evidence and not as the sole basis for credit, employment, or legal decisions.
We reserve the right to modify, suspend, or discontinue any feature of the platform at any time with reasonable notice, except where immediate action is required to protect the security or integrity of the platform or to comply with applicable law.
3. Account Registration & Security
To access the seeID platform you must register for an account. During registration you agree to provide accurate, current, and complete information about yourself and your organisation.
3.1 Tenant Workspaces
Institutions register as Tenants and are allocated a unique subdomain workspace (e.g. yourorg.seeid.co.za). Each Tenant is responsible for all activity conducted through their workspace,
including activity by team members added to that workspace.
3.2 Account Credentials
You are responsible for:
- Maintaining the confidentiality of your login credentials.
- Ensuring that all users added to your workspace are authorised employees or agents of your organisation.
- Immediately notifying us at legal@seeid.co.za if you suspect any unauthorised access to or use of your account.
3.3 Accuracy of Information
You must keep your account profile and organisation details up to date. We may suspend or terminate accounts that contain materially false or misleading information. Providing false information to obtain access to restricted services may constitute a criminal offence under the ECT Act.
3.4 One Account per Organisation
Each organisation may maintain one Tenant workspace. Creating multiple workspaces to circumvent plan limits is a breach of these Terms and may result in immediate termination of all associated accounts without refund.
4. Subscription & Billing
4.1 Plans and Pricing
seeID offers four subscription tiers:

All prices are quoted in South African Rand (ZAR) and exclude VAT unless otherwise stated. VAT at the prevailing rate will be added at checkout for VAT-registered entities.
4.2 Billing Cycle
Paid subscriptions are billed on a monthly basis. Your billing period begins on the date you complete payment and renews every 30 calendar days thereafter. Verification usage limits reset at the start of each new billing period. Unused verifications do not carry over to the next period.
4.3 Payment Processing
Payments are processed by a PCI-DSS compliant payment service provider. By submitting payment details, you authorise seeID to charge the applicable subscription fee to your payment method. seeID does not store raw card data. Please refer to your payment provider's terms of service and privacy policy for details of how your payment information is handled.
4.4 Renewals and Lapsed Subscriptions
Subscriptions do not auto-renew. You must manually renew your subscription before the end of your current billing period to maintain uninterrupted access. If your subscription lapses, your account will revert to Free plan limits. Unused days are forfeited; no pro-rated credit is given for a lapsed period.
4.5 Refund Policy
Subject to your rights under the Consumer Protection Act 68 of 2008, subscription fees are non-refundable once a billing period has commenced. If you believe a charge has been made in error, contact us at legal@seeid.co.za within 7 days of the transaction. We will investigate and, where a billing error is confirmed, issue a credit or refund at our discretion.
4.6 Price Changes
We may change subscription pricing at any time. We will provide at least 30 days' written notice (by email to your registered address) before any price increase takes effect. Continued use of the platform after the effective date constitutes acceptance of the new pricing.
5. Acceptable Use
You may use seeID only for lawful purposes and in accordance with these Terms. You agree that you will not, and will not permit any user in your workspace to:
5.1 Prohibited Activities
- Conduct identity verification on individuals without their knowledge and, where required by law, written consent.
- Use verification results to discriminate against individuals on the basis of race, gender, religion, disability, or any other ground protected under the Constitution of the Republic of South Africa or applicable legislation.
- Use the platform for surveillance, stalking, harassment, or any purpose that violates the dignity or privacy of any person.
- Resell, sublicense, or otherwise commercialise access to the seeID platform or its data outputs without prior written authorisation from seeID.
- Attempt to reverse-engineer, decompile, scrape, or extract data from the platform beyond what is provided through authorised API integrations.
- Introduce malicious code, conduct denial-of-service attacks, or otherwise interfere with the platform's security or availability.
- Circumvent or attempt to circumvent plan limits, access controls, or rate limits through technical or non-technical means.
- Use the platform to facilitate fraud, money laundering, or any other criminal activity.
5.2 Lawful Basis for Verification
You must ensure that each verification you conduct has a lawful basis under POPIA (section 11) or another applicable law. Common lawful bases include the data subject's consent, the performance of a contract to which the data subject is a party, compliance with a legal obligation, or the legitimate interests of your organisation where those interests are not overridden by the rights of the data subject.
We may audit your usage for compliance and may require you to demonstrate a lawful basis for verifications conducted through the platform.
6. Intellectual Property
The seeID platform, including its software, source code, design, text, graphics, logos, trademarks, and all other content, is the exclusive property of seeID (Pty) Ltd or its licensors. All rights not expressly granted under these Terms are reserved.
6.1 Limited Licence
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the platform for your internal business purposes. This licence does not include the right to:
- Copy or distribute any portion of the platform or its content.
- Modify or create derivative works based on the platform.
- Use any data mining, robots, or similar data gathering or extraction tools against the platform.
- Frame or mirror any part of the platform without our express written consent.
6.2 Your Content
You retain ownership of data and content you upload to the platform (e.g. subject photographs or documents). By uploading content, you grant seeID a limited, non-exclusive licence to process that content solely for the purpose of providing the verification service to you. We will not use your content for any other purpose or share it with third parties except as necessary to perform verifications or as required by law.
6.3 Feedback
If you submit feedback, suggestions, or ideas about the platform ("Feedback"), you grant seeID a perpetual, worldwide, royalty-free licence to use and incorporate that Feedback into the platform without restriction or compensation to you.
7. Data Processing
7.1 POPIA Compliance
seeID is a responsible party in respect of personal information it processes on its own account, and an operator in respect of personal information it processes on your behalf when providing verification services. We process personal information in accordance with POPIA and have implemented appropriate technical and organisational measures to safeguard that information.
7.2 Your Obligations as Responsible Party
When you use seeID to verify the identity of individuals, you are the responsible party for that personal information under POPIA. You must:
- Ensure you have a lawful basis for each verification.
- Notify data subjects that their information will be verified through a third-party service provider.
- Respond to data subject access, correction, and objection requests within the timeframes required by POPIA.
- Implement your own security measures to protect verification results stored in your systems.
7.3 Data Retention
We retain verification audit logs for a minimum of 5 years to comply with FICA and POPIA record-keeping requirements. Account data is retained for the duration of your subscription and for 12 months thereafter, after which it is securely deleted unless longer retention is required by law.
7.4 Security
We employ industry-standard security controls including encryption in transit (TLS 1.2 or higher) and at rest, role-based access controls, and regular penetration testing. In the event of a data breach that is likely to affect your rights or those of your subjects, we will notify you without undue delay as required by POPIA section 22.
7.5 Privacy Policy
Our collection and use of personal information in connection with the platform is further described in our Privacy Policy, which is incorporated into these Terms by reference.
8. Disclaimer of Warranties
The seeID platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by South African law, seeID expressly disclaims all warranties of any kind, whether express, implied, or statutory, including but not limited to:
- Implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
- Any warranty that the platform will be uninterrupted, timely, secure, or error-free.
- Any warranty regarding the accuracy, reliability, completeness, or timeliness of verification results returned from third-party data providers.
- Any warranty that defects in the platform will be corrected or that the platform is free of viruses or other harmful components.
Nothing in these Terms limits or excludes any implied warranty or right that cannot lawfully be excluded under the Consumer Protection Act 68 of 2008 or any other applicable South African legislation.
9. Limitation of Liability
To the maximum extent permitted by applicable law, seeID, its directors, employees, agents, suppliers, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business opportunities, arising out of or in connection with:
- Your use of, or inability to use, the platform.
- Any inaccuracy or incompleteness in verification results.
- Any unauthorised access to or use of our servers or any personal information stored thereon.
- Any interruption or cessation of the platform.
- Any decision made by you or a third party in reliance on verification results.
seeID's aggregate liability to you for all claims arising from or related to these Terms or the platform shall not exceed the total subscription fees paid by you in the 3 months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits seeID's liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot lawfully be excluded under applicable South African law.
10. Termination
10.1 Termination by You
You may close your account at any time by contacting us at legal@seeid.co.za or through the account settings page. Termination does not entitle you to a refund of prepaid subscription fees.
10.2 Termination by seeID
We may suspend or terminate your account immediately and without prior notice if:
- You breach any material provision of these Terms.
- We have reasonable grounds to believe your account is being used for fraudulent, illegal, or harmful purposes.
- You fail to pay fees when due and do not remedy the failure within 7 days of notice.
- Continuing to provide the service would expose seeID to legal or regulatory risk.
10.3 Effect of Termination
Upon termination, your right to access the platform ceases immediately. We will retain your data for the period required by law (see clause 7.3) and then securely delete it. Provisions of these Terms that by their nature should survive termination — including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, and Governing Law — shall survive.
11. Governing Law
These Terms and any dispute or claim arising out of or in connection with them (whether contractual or non-contractual) shall be governed by and construed in accordance with the laws of the Republic of South Africa.
Both parties submit to the non-exclusive jurisdiction of the South Gauteng High Court, Johannesburg, for the resolution of any disputes. Notwithstanding the foregoing, seeID may seek urgent interim relief in any court of competent jurisdiction.
If any dispute cannot be resolved through good-faith negotiation within 30 days of written notice from either party, either party may refer the dispute to mediation before a mediator accredited by the Arbitration Foundation of Southern Africa (AFSA) before resorting to litigation.
12. Changes to Terms
We reserve the right to amend these Terms at any time. When we make material changes, we will:
- Update the "Last updated" date at the top of this page.
- Send an email notification to the primary account holder at least 14 days before the changes take effect (30 days in the case of price increases).
- Display an in-app notice to active users.
Your continued use of the platform after the effective date of any amendment constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must cease using the platform and close your account before the effective date.
Non-material changes (such as corrections of typographical errors, clarifications that do not alter the substance of the Terms, or changes required by law) may take effect immediately.
